A.S, a mason by profession, appeared on February 12, 2024 before the Correctional Chamber of the TGI of Bobo-Dioulasso for breach of trust relating to the sum of 1,860,000 CFA francs belonging to A.B. According to the facts, A.S the mason received each time on his construction site A.B, a Koranic student who came there to beg. Given the state he was in, A.S suggested he give up begging. He put him in contact with other masons. A.B then started working with his new employers and earns nearly 2000 CFA francs per day.

Having acquired experience, A.S kept him on his construction sites and taught him how to make bricks. With his training in masonry and brick making, A.B decided to strike out on his own and sells his services on construction sites and manages to make money. He gives his savings to A.S. Thus, in two years, A.B claims to have paid the sum of 1,860,000 CFA francs to his “dad”, as he calls him, before he opened an account for him in a financial institution. the place.
But when A.B asked A.S for his money for a project he wanted to carry out, the latter only recognized 500,000 CFA francs. After several unsuccessful reminders, A.B brings A.S to court.

Before the correctional chamber of the TGI of Bobo-Dioulasso, A.S only admits 500,000 F CFA while, AB staunchly maintains that the money he paid to A.S amounts to 1,860,000 F CFA. An estimate of the payments that AB made over almost two years, during the hearing, approximates the amount he is claiming.

The prosecution then found A.S guilty of breach of trust involving the sum of 1,860,000 CFA francs. In his requisition he sentenced A.S to 12 months and a fine of 1 million CAF, all firm. The court for its part suspended these sentences. He recognized the merits of A.S who saved a child from the street even if he was not able to continue this charitable work. He asked A.S to reimburse A.B his 1,860,000 FCFA.
